Another Loss for Golf
The folks at Golf Entertainment Inc., which did business as Sienna Broadcasting Corp., suffered another blow on June 25, when a Pulaski County Circuit Court judge threw out its case against the Arkansas Securities Department.
Golf if you remember sued the securities department alleging it damaged Golf during an investigation into a settlement between the firm and its closely aligned organization, the Genesis Trust.
Golf claimed the investigation was “an overt and calculated effort to injure and adversely affect the public market” for the firm’s stock.
The securities department filed a motion to dismiss the lawsuit. At a hearing for the motion, the Golf folks didn’t show.
Circuit Court Judge Marion Humphrey then dismissed the suit on June 24. But Golf didn’t take the order lying down. It has asked the court to vacate the order because it didn’t know about the hearing.
“Had Plaintiffs received notice, they would have appeared and vigorously argued their case,” Golf’s attorney John Dodge of Lowell said.
Dodge wants the hearing for the motion to dismiss to be reset. The court hasn’t ruled yet on Dodge’s motion. The order was the second recent setback for Golf.
