We hear the threat of a lawsuit is what made Rita Allured paint over her white-lettered sign about 1.2 miles past the Arkansas Highway 12 bridge near the B&E Grocery parking lot in Rogers. The 36-SF sign read, “Lindsey and Associates for sale.”

No, Lindsey & Associates Inc. is not for sale. That was just Allured’s way of getting back at the Fayetteville-based real estate company for keeping her Rogers lakefront bed-and-breakfast inn listed for a year after its listing expired. The controversy has apparently gotten nasty, and the word is Allured is the one now looking for an attorney.

The story is Allured, an agent with Rimes Valley Resort on Arkansas 12, built a 5,000-SF, six-bedroom house on Beaver Lake and later decided to sell it. It was on the market with Lindsey for between $700,000 and $800,000 but didn’t sell. Finally, the listing ran out and Allured converted the house to a bed and breakfast and began enjoying a successful business.

She later tried to sell it to a number of clients for about $1.5 million, but every time it seemed that a buyer was interested, they would all of a sudden turn cold. She claims that’s because Lindsey was still listing the property on the Internet for the lesser amount.

Apparently, Allured has already reported the matter to the Arkansas Real Estate Commission, which in turn told her to hire an attorney because the maximum reimbursement it could give her is $50,000. That’s also the maximum fine to Lindsey if the allegations prove true.

John David Lindsey, whose Rogers office listed the property, couldn’t be reached for comment.
