Federal Judges Will Not Block Certification Of Contested Vote

The judges in a federal lawsuit challenging the way a state Senate district was reconfigured last year said today (Tuesday, May 29) they will not block certification of the results of the May 22 Democratic primary in the district.

The day after the election, state Sen. Jack Crumbly, D-Widener, and 23 other plaintiffs in the suit filed a motion for an order barring Secretary of State Mark Martin from certifying the results in Senate District 24, where state Rep. Keith Ingram of West Memphis defeated Crumbly, the incumbent. No Republican is seeking the seat.

The judges said today the motion was essentially a repetition of the plaintiffs’ previous motion to postpone the primary election in the district, which also was denied.

strong>Crumbly said today he did not believe the ruling was an indication of how the judges would ultimately rule in the lawsuit. He noted that in their previous ruling denying a postponement of the election, the judges said the decision had no bearing on how they would rule on the merits of the case.

“I assume the judges are doing their due diligence and taking their time and looking at all the evidence,” he said.

Ingram won the District 24 primary with 61 percent of the vote, according to unofficial results from the secretary of state’s office.
