J.C. Penney Bill Rumples Gravette Firm
A Northwest Arkansas company says the retail giant J.C. Penney Corp. of Plano, Texas, stiffed it out of nearly $4 million for an installation project.
R&R Solutions of Gravette signed a contract in April with J.C. Penney that was worth more than $9 million, according to R&R’s lawsuit filed in U.S. District Court in Fayetteville. R&R wouldn’t say exactly what products and services it sold the retailer, but it involved the installation of data and electrical cables and routers to J.C. Penney stores across the country for its network and Wireless Infrastructure Refresh Project.
R&R said in the lawsuit J.C. Penney was required to pay for certain charges in advance, but it didn’t. Still, R&R finished its work, but only received payment for $5.07 million as of July 22.
It accused J.C. Penney of using its “superior economic position … to force R&R to take unwarranted deductions.”
R&R said the outstanding balance had caused it “significant economic harm and damages with its other vendors, suppliers and customers.”
R&R wants a judgment of more than $4 million from J.C. Penney. A spokesperson for J.C. Penney didn’t immediately return a call for comment.
