Fayetteville developer Tom Terminella has filed a new complaint against Metropolitan National Bank of Little Rock, this time in Washington County.

The Arkansas State Supreme Court on October 28 dismissed a previous suit Terminella filed against the bank. The Court stated that no final judgment had been made by Washington County Circuit Court Judge Kim Smith and that the suit was still open to appeal in the Washington County venue.

Terminella suits filed in Benton and Pulaski counties against MNB were dismissed earlier this year.

The new 20-page suit filed November 22 alleges MNB interfered with a contract, engaged in deceptive trade practices and was negligent.

The developer is seeking $50 million in damages, the same amount sought in the original complaint filed in 2007.

Terminella told the Northwest Arkansas Business Journal on November 4 he would seek a jury trial in Washington County.

MNB did not comment on the suit.
