Barber Group Battles World
A little more digging turned up the rest of the details on the dispute between The Barber Group and World Granite and Stone Art we told you about in Whispers July 2.
We missed it the first time around, but we now know the battle already has a court date for a non-jury trial Feb. 12, 2008.
Turns out The Barber Group, acting through the Lynnkohn LLC which owns The Legacy Building, sued World Granite for slander of title and abusing the lien process on March 23 after the company filed a $231,348 lien for labor and materials against the property on March 9.
World Granite withdrew the lien and refilled it, this time for $392,398 on March 27, forcing Barber Group CEO Brandon Barber to take out a $784,796 bond to release the lien in order to complete the project and sell the condos.
World Granite president Chuck Laminack Jr. then filed a counterclaim on April 6, demanding $1.64 million. The figure includes $500,000 Laminack claims is due under an exclusive supplier agreement plus damages to Laminack’s business and credit.
Laminack charges Barber did not purchase or install the $113,709 worth of granite he says he procured for The Legacy on multiple trips to Brazil and Italy in 2006.
In Lynnkohn’s answer to Laminack’s suit, the company states the supplier agreement was not binding and if it is held to be binding, then World Granite was in violation of it.
