Hudlow Gains Preliminary Victory

In case the news slipped past you last week, a federal judge in Fayetteville ruled that former Rogers city treasurer and CFO Jerry Hudlow’s lawsuit against the city and mayor Greg Hines will go forward.

Hudlow, who was fired in May, is suing for wrongful termination. His complaint was filed Aug. 1 in the U.S. District Court for the Western District of Arkansas, and the case was assigned to Judge Jimm Larry Hendren

The city had filed a motion to dismiss Aug. 22, claiming Hudlow was an at-will employee, meaning an employee can be terminated at any time.

“The Court finds that Mr. Hudlow has stated sufficient facts to allege a legitimate expectation of continued employment as City Treasurer for the City of Rogers,” Hendren wrote in his order. “Therefore, defendants’ motion will be denied.”

No trial date has been set.
