California Investigating Beverly for Criminal Charges

In it’s first-quarter filing with the U.S. Securities and Exchange Commission, Fort Smith’s Beverly Enterprises Inc. announced that the State of California authorities are investigating the company for possible criminal charges.
In the May 15 filing, Beverly said California officials notified administrators on April 29 of an investigation regarding the company’s patient care during 1998-2001 in the nursing-home operator’s California facilities. The inquiry stems from an undisclosed number of civil citations, according to the filing, and most of the violations were resolved by payment of penalties.
Beverly is currently discussing the situation with the state of California, and it is unable to predict how the discussions will end. In the filing, Beverly said the company cannot assess the nature or significance of any charges that could be filed.
