Genesis Commercial, Anchor Asset Management reach settlement in court case

A civil lawsuit involving a Bentonville broker’s ownership in Genesis Commercial and Versailles Property Management looks to be settled, according to court records. The complainants and respondents have reached a settlement agreement and seek to dismiss the case.

In a Feb. 12 filing, complainants Grady Mathews, Genesis Commercial and Versailles Property Management reached the agreement and asked the court “to dismiss all claims and causes of action asserted in this action with prejudice to the refiling thereof.” The complainants and respondents would be responsible for their own costs and attorneys’ fees. The document was signed by the attorneys for the complainants and the respondents.

The lawsuit was filed Jan. 8 in Benton County Circuit Court. The complainants claimed that a deal to combine Mathews’ companies under a holding company was fraudulent and misrepresented, and that it was a means to force him out of the companies.

The respondents were Scott Audrain of Fayetteville and Anchor Asset Management Group. Todd Lewis and Brian Thomas, both of Conner & Winters LLP in Fayetteville, represent the complainants. Kyle Unser of Kutak Rock in Rogers represents the respondents. The case was assigned to Judge Christine Horwart of the 19th West Circuit Division 7 in Bentonville.

In an answer filed Jan. 30, the respondents denied the claim that the deal to combine Genesis Commercial and Versailles Property Management was a means to take control of the companies. The claim “is absurd,” the filing shows.
