ADEQ Finds Pollution Violation at Kessler Mountain Site
Local developer Tom Terminella in November filed a complaint with the Arkansas Department of Environmental Quality over the city of Fayetteville’s construction site at the Kessler Mountain regional park.
Turns out, Terminella’s complaint had merit. Officials with ADEQ went to the site during a 2.8-inch rainstorm and took photos of turbid water leaking into a nearby creek. The ADEQ concluded that the city had violated Arkansas Code Annotated 8-4-217 and requested evidence of new pollution controls and inspection reports.
In development circles, Fayetteville is notorious for its red tape. It’s only fitting, then, that as the city develops its regional park that it be made to play by the state’s rules.
