AG Rejects Marijuana Legalization Title
Attorney General Leslie Rutledge on Monday (Oct. 26) rejected a ballot title meant to legalize the cultivation, sale and use of the cannabis plant and all products derived from it throughout the state by Arkansans age 18 and over.
The amendment, proposed by Mary Berry of Summit, would have freed all inmates convicted only of marijuana crimes and would have expunged their records. Growers could cultivate up to 36 plants, state licenses for the production and distribution of marijuana would be capped at $250, and sales taxes would be limited to 5%. Persons under age 18 would be allowed to use marijuana if authorized by a physician to treat an illness.
Rutledge said she rejected the proposal because of ambiguities in the title, such as the legalization of “all products produced from the cannabis plant.” She wrote that the required freeing of inmates incarcerated on marijuana charges could have affected those convicted of driving while intoxicated.
