Siloam Springs Sues Metal Recycling Firm
The city of Siloam Springs is seeking a restraining order and permanent injunction against USA Metal Recycling LLC, which it says is operating a facility there without a business license.
A lawsuit filed Monday in Benton County Circuit Court asks the court to allow the city discontinue electric service to the plant, which it claims is also located in an area not zoned for that type of business.
The suit states that USA Metal said in April that it would voluntarily cease operations at its current location and move to an area that complied with zoning regulations.
The city’s community development director gave the metal recycling firm until Oct. 6 to stop operations, the suit states. On Sept. 25, the company asked for a deadline extension, but the city denied the request.
“Defendant’s continued unlawful operation is generally causing a nuisance and Defendant’s residential neighbors are suffering Defendant’s unsightly, noisy, dusty and dirty conduct,” the suit states.
