Kansas Contractor Miffed With NWA Conservation Authority

A Topeka, Kan., contractor is fuming over work it said it performed on a $28.8 million wastewater treatment plant for the Northwest Arkansas Conservation Authority.

BRB Contractors Inc. said it is owed at least $1 million as a result of a number of problems with the project, including the discovery of subsurface water in one section of the site that “required significant additional costs and delayed the work on the project,” according to BRB’s lawsuit filed in U.S. District Court in Fayetteville.

The facility, on 479 acres, opened in November 2010 and mainly serves the cities of Bentonville and Tontitown, according to NACA’s website.

BRB won the bid to build the treatment plant in 2009 for $24.1 million, and in 2010 it won another bid to build a $4.7 million advanced filtration system and do related improvements. BRB is suing on several counts, including breach of contract and breach of warranty.
