Brandon Barber’s Divorce Delayed by Bankruptcy

Brandon Barber’s bankruptcy petition filed on July 31 seems to be getting in the way of his pending divorce.
Barber’s divorce proceeding, which will establish the terms of child support, child custody and the division of any property the couple may own, is on hold pending the outcome of the bankruptcy.
According to bankruptcy law, if a bankruptcy case is filed at the time that a divorce case is pending, the automatic stay prevents the divorce court from considering any divorce issues.
But Barber’s estranged wife, Keri Barber, doesn’t want to wait.
Her attorney filed a motion in Washington County court asking that the automatic stay be lifted, allowing the divorce proceedings to move forward as scheduled.
The Barbers are scheduled to appear in court in November to hash out the terms of the divorce.
