Homeland: The Peaks Gets Sincere

Since we last wrote about Dionne Caruthers and Sincerity Homes leaving 53 homes unfinished at The Peaks in Rogers, we’ve discovered there is more than $1 million in contention.

More importantly, the materialman’s lien Caruthers filed against the development has made it impossible for The Peaks to sell the homes, the counterclaim indicated.

Aaron Nickell Homes Inc. of Lowell took over the home construction in May.

Caruthers filed a complaint in the Benton County courthouse on Aug. 8 claiming Sincerity still owed $1.2 million to subcontractors on the housing project, in addition to about $500,000 in other costs Sincerity incurred.

The Peaks thinks it’s more like $28,000 of the $1.2 million claimed.

In addition, The Peaks folks say Caruthers hasn’t accounted for $938,000 she allegedly withdrew from the bank.

In the counterclaim, the defendants, The Peaks at Pinnacle Hills LLC and Peaks Homes 2 LLC, say they had to end Caruthers’ building contract in April since Sincerity was “drastically behind schedule” and several contractors and materialmen had not been paid.

The counterclaim stated Caruthers spent “hundreds of thousands of dollars” from a construction account at Chambers Bank for purposes unrelated to The Peaks development.

The Peaks’ developers are Collins Haynes, John Ed Chambers, John David Lindsey, Neil Johnson and Gerald Johnston.
