Wal-Mart Wins Class-Action Battle in Texas Lawsuit

Wal-Mart Stores Inc. won’t face a class-action suit claiming it discriminates against female employees in Texas.

The suit filed in October 2011 claimed the world’s largest retailer discriminates against female employees by denying them raises and promotions.

U.S. District Judge Reed O’Connor ruled Monday in Dallas that the plaintiffs’ claims “are barred by the statute of limitations, and should be dismissed.”

However, women can still file complaints on an individual basis.

“We are pleased that the district court has dismissed the class-action claims, recognizing the individuals must pursue their own claims,” Theodore Boutrous Jr., an attorney for Wal-Mart, told Bloomberg News on Monday.

The plaintiffs’ attorney, Joseph Sellers, said they will appeal.

Since the U.S. Supreme Court overturned class-action status last year in a national suit that sought to represent up to 1.5 million current and former employees, four lawsuits have been filed seeking class certification on a regional level.

A case in California is pending, and similar suits were filed earlier this month in Florida and the Tennessee region — which includes parts of Arkansas.
