Gov. Mike Beebe requested an opinion from Attorney General Dustin McDaniel regarding the recent election in Arkansas House District 24.
The election was won by Republican nominee Keith Crass, who died after the ballot had been set, but before the general election.
Under Arkansas law, these circumstances create a "vacancy in election." However, the law does not provide a specific procedure or method to address such a vacancy, according to Beebe’s office.
Beebe’s opinion request asks whether he can in fact call a special election to fill the District 24 seat, and if so, whether that can happen immediately, or if it must wait until the seat is vacated in January when current State Rep. Rick Saunders will be term-limited.
